Welcome to Vayu Aerial Yoga. These Terms of Service (“Terms”) govern your access to and use of vayuaerialyoga.com (the “Site”) and any products, services, educational materials, courses, trainings, memberships, digital content, or other offerings made available through the Site (collectively, the “Services”).
The Site and Services are operated by Vayu Aerial Yoga (“Vayu,” “we,” “us,” or “our”).
By accessing the Site, purchasing a product or service, registering for a course or training, creating an account, or otherwise using our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.
1. Eligibility and Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the Site in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to the Site, accounts, servers, or systems;
- Interfere with the operation or security of the Site;
- Copy, scrape, reproduce, distribute, or commercially exploit Site content without authorization;
- Use our educational materials to create unauthorized courses, trainings, certifications, or derivative instructional materials; or
- Misrepresent your affiliation with Vayu Aerial Yoga or your qualifications, certification, or training status.
We reserve the right to suspend or terminate access to the Site or Services for violations of these Terms.
2. Classes, Workshops, Courses, and Trainings
Vayu Aerial Yoga may offer in-person or online classes, workshops, educational programs, teacher trainings, continuing education, and other instructional experiences.
Registration does not guarantee completion, certification, or any particular professional outcome.
Certain programs may have prerequisites, attendance requirements, assessments, practical requirements, or other standards that must be satisfied before a participant receives a certificate or other recognition of completion.
Program requirements may vary by course and will be communicated through the applicable registration page, course materials, or program policies.
3. Physical Activity and Assumption of Risk
Aerial yoga, yoga, movement training, and related physical activities involve inherent risks, including falls, strains, sprains, bruising, dizziness, equipment-related injuries, and other physical injury.
Participation in any physical activity offered or taught through Vayu Aerial Yoga is voluntary.
You are responsible for determining whether you are physically capable of participating safely. You should consult an appropriate healthcare professional before participating if you have a medical condition, injury, are pregnant, have recently undergone surgery, or have any other reason to question whether participation is appropriate for you.
You agree to follow instructor directions, equipment requirements, safety procedures, and any participation restrictions applicable to a class, workshop, or training.
Participation in an in-person class, workshop, or training may also require execution of a separate waiver, assumption-of-risk agreement, or release of liability.
4. Educational Information; No Medical Advice
Information provided through the Site, courses, trainings, videos, written materials, or other Services is intended for educational and informational purposes only.
Nothing provided by Vayu Aerial Yoga is intended to constitute medical advice, diagnosis, treatment, physical therapy, or other healthcare services.
You should not disregard professional medical advice or delay seeking medical care because of information obtained through Vayu Aerial Yoga.
5. Instructor and Teacher Training
Completion of a Vayu Aerial Yoga training or educational program does not independently authorize a participant to provide medical services or practice within a regulated healthcare profession.
Participants and instructors are responsible for understanding and complying with all laws, professional licensing requirements, insurance requirements, facility requirements, and scope-of-practice rules applicable to their own activities.
Where Vayu provides instructor credentials, certificates, or other recognition, those credentials remain subject to the requirements and policies of the applicable Vayu program.
Vayu reserves the right to modify training requirements, educational standards, certification requirements, or instructor policies as reasonably necessary to maintain the quality, safety, and integrity of its programs.
6. Purchases and Payment
Prices for products, courses, trainings, memberships, or other Services are displayed at the time of purchase and are subject to change.
You agree to provide current, complete, and accurate billing and payment information.
Payments may be processed by third-party payment processors. Your payment information may therefore also be subject to the terms and privacy practices of the applicable payment provider.
We reserve the right to refuse or cancel an order or registration where reasonably necessary, including in cases of pricing errors, suspected fraud, unauthorized transactions, or failure to satisfy program prerequisites.
7. Cancellations, Refunds, and Transfers
Refunds, cancellations, transfers, rescheduling, and credits are governed by the policy disclosed for the applicable product, class, event, course, or training at the time of registration or purchase.
Unless otherwise stated in writing, fees are not refundable merely because a participant fails to attend, complete, or use a purchased program or service.
If Vayu cancels a program or event, participants will receive the remedy stated in the applicable cancellation policy, which may include a refund, credit, transfer, or rescheduled program.
Vayu is not responsible for incidental expenses incurred by participants, including airfare, lodging, transportation, or other travel expenses, unless expressly agreed otherwise in writing.
8. Digital Products and Online Content
Certain Services may include videos, downloadable materials, online courses, recordings, manuals, photographs, illustrations, presentations, or other digital content.
Unless expressly stated otherwise, purchasing or receiving access to digital content grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use that content for your own educational purposes.
You may not:
- Share your login or account access with another person;
- Copy or distribute course videos or materials;
- Upload Vayu materials to file-sharing, social media, artificial intelligence, machine-learning, or other third-party platforms;
- Record, reproduce, republish, sell, sublicense, or commercially distribute the materials;
- Use the materials to create a competing or substantially similar training program; or
- Remove copyright, trademark, attribution, or proprietary notices.
Access periods, where applicable, will be stated at the time of purchase.
9. Intellectual Property
The Site and its contents, including text, graphics, photographs, videos, course materials, manuals, illustrations, designs, logos, names, trademarks, instructional materials, and other content, are owned by or licensed to Vayu Aerial Yoga and are protected by applicable intellectual property laws.
Except for the limited rights expressly granted under these Terms, no intellectual property rights are transferred to you.
The Vayu Aerial Yoga name, branding, course names, logos, and related identifiers may not be used in advertising, business names, domain names, social media accounts, products, courses, or services without authorization.
10. User Accounts
Certain Services may require an account.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Accounts are intended for the registered user only and may not be shared, transferred, sold, or made available to others.
Please notify us promptly if you believe your account has been accessed without authorization.
11. Third-Party Services and Links
The Site may contain links to or integrations with third-party websites, payment processors, video platforms, scheduling platforms, social networks, or other services.
Vayu does not control these third-party services and is not responsible for their content, availability, security, policies, or practices.
Your use of third-party services may be subject to separate terms and privacy policies.
12. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and Services are provided on an “as is” and “as available” basis.
Vayu does not guarantee that the Site or Services will be uninterrupted, error-free, or suitable for every individual, or that participation in any program will produce a particular physical, educational, professional, or financial result.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, Vayu Aerial Yoga and its owners, officers, employees, contractors, instructors, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Site or Services.
To the fullest extent permitted by law, Vayu's aggregate liability arising from a purchased Service will not exceed the amount you paid to Vayu for the specific Service giving rise to the claim.
These limitations do not apply where liability cannot lawfully be limited or excluded.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Vayu Aerial Yoga and its owners, officers, employees, contractors, instructors, affiliates, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Site or Services, your violation of these Terms, or your infringement of another person's rights.
15. Privacy
Your use of the Site is also subject to our Privacy Policy.
By using the Site, you acknowledge that information may be collected and processed as described in that policy.
16. Changes to Programs and Services
We may modify, discontinue, reschedule, or update Services, instructors, program formats, curricula, schedules, pricing, or Site features from time to time.
For an existing paid registration, any material changes will be handled in accordance with the policies applicable to that registration and applicable law.
17. Force Majeure
Vayu will not be responsible for delays, cancellations, or failures caused by circumstances reasonably beyond our control, including severe weather, natural disasters, government actions, public health emergencies, transportation disruptions, facility closures, internet or technology outages, labor disruptions, or similar events.
Any refund, credit, transfer, or rescheduling available under such circumstances will be determined by the applicable program or event policy and applicable law.
18. Governing Law
These Terms are governed by the laws of the state in which Vayu Aerial Yoga's principal business entity is organized or maintains its principal place of business, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Services will be brought in a court of competent jurisdiction as permitted by applicable law.
19. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Site following an update constitutes acceptance of the revised Terms to the extent permitted by law.
20. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
21. Entire Agreement
These Terms, together with any applicable registration terms, refund or cancellation policies, waivers, Privacy Policy, and other policies expressly incorporated into a transaction, constitute the agreement between you and Vayu concerning the applicable Site or Services.
